The "Selbstbestimmungsgesetz (SBGG)" came into legal force on 1 November 2024.
The Act on Self-Determination with regard to Gender Registration and on the Amendment of Further Legislation, or the "Selbstbestimmungsgesetz (SBGG)" for short, enables simplified changes to gender registration and first names. This is intended to significantly strengthen the personal rights of transgender, intersex and non-binary people.
The "Selbstbestimmungsgesetz (SBGG)" was passed by the Bundestag on 12 April 2024 and promulgated in the "Bundesgesetzblatt" on 21 June 2024. § 4 SBGG came into force on 1 August 2024. This section requires that the change of gender entry and first name must be registered with the registry office three months before the declaration is made.
The "Selbstbestimmungsgesetz (SBGG)" replaces the "Transsexuellengesetz (TSG)" from 1980, which has been declared unconstitutional in significant parts by the Federal Constitutional Court in several decisions over the last few decades. An assessment and court procedure, as provided for in the TSG, is therefore no longer required for the change of gender entry and first names.
